Lindsay Lohan loses lawsuit against Pitbull
Lindsay Lohan has lost the lawsuit filed against rapper Pitbull. The actress was furious that her name was used in Pitbull's song "Give Me Everything."
"So, I'm toptoein', to keep flowin', I got it locked up, like Lindsay Lohan, " Pitbull raps. Lindsay claimed that the lyrics was a violation of her publicity and publicity rights, so she attempted to seek a portion of the profits.
According to TMZ, a New York federal judge threw out Lindsay's case citing that she had no grounds to sue Pitbull as the song is a form of artistic expression and is therefore protected by the First Amendment to the United States Constitution.
"The fact that the Song was presumably created and distributed for the purpose of making a profit does not mean that plaintiff's name was used for 'advertising' or 'purposes of trade' within the meaning of the New York Civil Rights Law," writes the judge.
The Court finds that plaintiff's claims are not so frivolous as to warrant the imposition of sanctions," says the judge.
Pitbull was surprised about the lawsuit emerged by Lindsay, thinking that was a joke. The rapper said in an interview that "I was very surprised when I found out about the lawsuit. At first I read it and I thought, 'This has got to be a joke."
He also declared, "When I say "you got it locked up" it means you run that area. In no way shape or form would I want to bring that on anyone. I didn’t look to defamate [sic], degrade or hurt someone’s career."
